Federal court ensures access to abortion drug but with stricter rules

NEW YORK — A federal appeals court has ruled that an abortion drug will remain available, under certain temporary restrictions.

The new rules will mean mifepristone can only be prescribed by doctors – but can be approved for use up to ten weeks into pregnancy, rather than up to seven.

The 5th U.S. Circuit Court of Appeals in New Orleans ruled Wednesday just before midnight and the case may now be headed to the U.S. Supreme Court.

It follows a Texas court ruling that invalidated the approval of the drugover ‘safety’ concerns, appealed by the Department of Justice.

The prior ruling had completely blocked the FDA’s approval of the drug following a lawsuit by mifepristone’s opponents, and prompted some states to start stockpiling the drug.
